Welcome to Gann Diamonds. These Terms of Service govern your access to and use of ganndiamonds.com (the "Site") and any services we provide. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Throughout these Terms, the words "we," "us," "our," and "Gann Diamonds" refer to the private jewelry design studio operated by Melissa Gann, Graduate Gemologist (GIA), located in Edmond, Oklahoma. The words "you" and "your" refer to any visitor or client of the Site.

Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations, including various limitations and exclusions.

By accessing the Site, submitting a contact form, booking a consultation, or commissioning a custom piece, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

Your continued use of the Site following any updates to these Terms constitutes your acceptance of those changes. We reserve the right to modify these Terms at any time, with updates posted to this page. It is your responsibility to review them periodically.

 

Gann Diamonds is a private design studio. We operate by appointment only. We do not maintain a retail showroom, hold ready-made inventory, or offer walk-in service. Every piece we create is custom-designed and built for a specific client based on their stone selection, design preferences, and budget.

Consultations are scheduled directly through email at melissa@ganndiamonds.com or by phone at +1 405-819-0051. All custom commissions begin with a private consultation and progress through a defined process that includes stone sourcing, design rendering, wax modeling, casting, and stone setting.

Because each commission is unique, timelines, pricing, and specifications are confirmed individually in writing with each client before work begins.

 

This Site is intended for personal, non-commercial use. You agree not to:

Reproduce, duplicate, copy, sell, or exploit any portion of the Site without our express written permission.

Use the Site for any unlawful purpose or in violation of any local, state, federal, or international law.

Transmit any viruses, malware, or harmful code through the Site.

Attempt to gain unauthorized access to any part of the Site, our servers, or any related systems.

Collect or harvest personal information of other users, including through automated tools such as bots, spiders, or scrapers.

Use the Site in a way that could interfere with its operation or impair another user's experience.

Violation of any of these conditions may result in immediate termination of your access to the Site.

 

This Site is hosted on the Shopify platform. Shopify provides us with the e-commerce infrastructure that supports our website and certain features, including secure data transmission and customer interaction tools.

We also use the following third-party services to operate the Site:

Google Analytics for understanding visitor behavior and improving the Site experience.

Shopify Inbox for the chat widget that allows visitors to message us directly.

An accessibility widget powered by All in One Accessibility to enhance usability for individuals with disabilities.

Each of these services has its own terms of use and privacy practices, which we recommend reviewing on their respective websites.

 

Consultations at Gann Diamonds are free, private, and carry no obligation to commission a piece. By scheduling a consultation, you agree to provide accurate contact information and to honor the scheduled appointment time or notify us in advance if you need to reschedule.

Information shared during a consultation, including design preferences, budget, and personal context, is treated with discretion. We use this information solely to provide the services you have requested.

We reserve the right to decline a consultation request or to end an engagement if we determine, in our sole discretion, that we cannot provide the service requested or that the engagement is not a good fit for our practice.

 

Custom commissions are governed by an individual written agreement between Gann Diamonds and the client. The agreement confirms the specifications of the piece, including stone selection, metal type, design details, timeline, and total cost.

Because each piece is bespoke and built to the client's specifications, custom commissions are non-cancellable and non-refundable once stone setting and casting have begun. Cancellation requests made before these stages will be reviewed on a case-by-case basis, with any deposits applied as detailed in the individual commission agreement.

All design work, renderings, sketches, and CAD files produced by Gann Diamonds remain our intellectual property unless otherwise specified in writing. Clients may not reproduce, share, or use these designs for any commercial purpose without our written permission.

 

All pricing is confirmed individually with each client in writing before any work begins. Quotes are valid for thirty days from the date provided and may be subject to revision if stone availability, metal prices, or specifications change.

Payments are processed securely through Shopify Payments and other authorized payment processors. Credit card and payment information is encrypted during transmission. We do not store full payment details on our servers.

Typical payment structure for a custom commission includes an initial deposit at the time the agreement is signed, with the balance due before the completed piece is delivered. Specific payment terms are confirmed in each commission agreement.

 

Completed pieces are shipped or delivered as outlined in each commission agreement. All shipped pieces are fully insured during transit. Delivery options are discussed at the time of commission and may include in-studio pickup or insured shipping to an address you designate.

Risk of loss transfers to the client upon delivery confirmation. We require signature confirmation on all shipments and recommend that clients are present to receive their pieces personally.

Because every piece is custom-made to client specifications, all completed commissions are final sale. Gann Diamonds does not accept returns of custom-made jewelry once production has been completed.

We stand behind the craftsmanship of every piece we create. If a defect in workmanship is identified within a reasonable timeframe after delivery, we will repair or remake the piece at no cost to the client. This warranty does not cover damage from normal wear, accidental damage, modifications made by another jeweler, or loss.

All content on this Site, including text, images, photography, design renderings, logos, and branding, is owned by Gann Diamonds or licensed to us. This content is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or use any content from this Site for commercial purposes without our prior written consent. Personal, non-commercial viewing of the Site is permitted.

The "Gann Diamonds" name, logo, and associated marks are trademarks of Gann Diamonds. Unauthorized use of these marks is prohibited.

 

We make every reasonable effort to ensure that information on the Site is accurate and current. However, we do not warrant that all content is error-free, complete, or current at all times. Information about pieces, services, pricing, and availability may be updated without notice.

Photographic representations of jewelry, stones, and metals are intended to illustrate the quality and style of our work. Actual appearance may vary slightly due to monitor display settings, lighting conditions, and the unique nature of each handmade piece. We do not warrant that your monitor display of any color will be perfectly accurate.

Historical content, including past completed pieces shown on the Site, is provided for reference and inspiration. These pieces are not for sale and cannot be reproduced exactly, as each was created for a specific client.

 

Any messages, design ideas, reference images, or other content you voluntarily submit to us, whether through our contact form, email, or any other channel, may be used by Gann Diamonds for the purposes of providing the services you have requested or improving our practice.

By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and reference that content for the purpose of fulfilling our engagement with you. We will not publicly publish, share, or display your personal images, identity, or design files without your express permission.

You agree that any content you submit will not violate the rights of any third party, including copyright, privacy, or trademark rights, and will not contain unlawful, harmful, or offensive material.

 

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you visit the Site or engage with our services. By using the Site, you agree to the practices described in that policy.

THE SITE AND ALL CONTENT PROVIDED ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free. We do not warrant that defects will be corrected, or that the Site is free of viruses or other harmful components.

Your use of the Site is at your sole risk. To the fullest extent permitted by applicable law, we disclaim all warranties not expressly set forth in these Terms.

 

To the fullest extent permitted by law, in no event shall Gann Diamonds, its owner, employees, contractors, suppliers, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, loss of goodwill, or other intangible losses, arising from your use of or inability to use the Site or our services.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you paid to Gann Diamonds in the twelve months preceding the claim, or one hundred dollars, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

 

You agree to indemnify, defend, and hold harmless Gann Diamonds, its owner, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in connection with your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

 

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions. The remaining provisions shall continue in full force and effect.

 

These Terms remain in effect while you use the Site. We reserve the right to suspend or terminate your access to the Site at any time, without notice, if we determine that you have violated these Terms or for any other reason at our sole discretion.

Provisions of these Terms that by their nature should survive termination, including disclaimers, limitations of liability, indemnification, and intellectual property rights, will continue to apply after termination.

 

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma.

You agree to submit to the personal jurisdiction of such courts and waive any objection based on inconvenient forum.

 

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, Accessibility Statement, and any individual commission agreement, constitute the entire agreement between you and Gann Diamonds regarding your use of the Site and our services. Any prior agreements, understandings, or representations are superseded by these Terms.

The failure of Gann Diamonds to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

 

We may update these Terms from time to time to reflect changes in our practices, our services, or applicable law. When we update the Terms, we will revise the "Effective Date" at the top of this page. Significant changes will be communicated through a notice on the Site.

Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.
